The cash bail system is unfair. Both federal and state lawmakers and judges acknowledge a problem. California’s new law tries to fix that problem, but it may be worse than what we have now. When your bill is opposed by the ACLU, law professors, defense bar, public defenders, and women’s rights organizations, it is unlikely to help the accused. At times, the bill even faced opposition by some of the lawmakers who voted for it and the California Court’s Judicial Counsel. While the law may be problematic, it is good that we acknowledge the problem and try to solve it. There will certainly be more changes to the laws of bail before this is over. We have an opportunity to create a better system than has ever existed in history.
